If you and your spouse are considering adopting a child in Virgnia, you probably have many questions. The adoption process involves several steps and requirements and it is important to have a general idea of what is involved before deciding whether you want to adopt.

Eligibility requirements

Before you decide, you must determine if you are eligible to adopt. There are various requirements to adoption that very based on the type of adoption.

An adoption can be open or closed and involve infants, children or adults. Open adoption means the adopted child can maintain contact with their biological parents, while a closed adoption legally prohibits communication.

However, all adoptions in Virginia require that the adoptive parents be at least 18 years old and be financially capable of taking care of a child. You and your spouse will also need to pass criminal backgrounds checks.

The home study

For example, you must show that your home has necessities such as lighting, plumbing, heating and a bedroom for the child Your home must be free of dangers or hazards to a child and comply with local building, safety and zoning laws.

Additionally, you must show that you can provide transportation for a child. You must have a valid driver’s license, current insurance and reliable transportation.

You and your spouse will be interviewed as part of the home study. Your friends and family may also be interviewed.

Some of the interview questions might be about your health. You must generally show that your physical health is good enough to handle the daily demands of caring for a child.

A health condition should not typically automatically disqualify you from adopting a child unless it interferes with your ability to care for a child.

Your mental health will also be considered. You do not necessarily need to prove that you are mentally fit, but if you have any mental health conditions, you should show that they are under control.

Appearing in court

You will need to appear in court for a hearing as part of the process. The hearing is your chance to provide evidence that you are fit parents who can provide an environment that is in the best interest of a child.
